1. Introduction

   Welcome to AVCheck (“the App”). By using the App, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms, you must not use the App.

2. Description of Service

   The App allows users to authenticate products by capturing and analyzing surface images. These images are stored locally on your device and remotely on our servers. The use of some features of the App might require a valid login.

3. Account

   To access some features of the App, users might be required to create an account. The terms, will be clearly presented during the account creation process.

4. No Guarantee of Performance

   While we strive to provide accurate product authentication, we make no guarantees regarding the accuracy, completeness, or reliability of the results. You acknowledge that the App may not function as intended under all circumstances and that the results may vary. You use the App at your own risk.

5. Disclaimer of Liability

   To the fullest extent permitted under Swiss law, we disclaim any responsibility for any loss, damage, or inconvenience caused by the failure of the App to perform as expected. Under no circumstances shall we be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the App. Our liability is limited to cases of gross negligence or unlawful intent, as provided by Swiss law.

6. Modifications to Service

   We reserve the right to modify, adapt, or discontinue the App or any features at any time without notice. You agree that we shall not be liable for any modification, suspension, or discontinuance of the service, in accordance with Swiss law.

7. Intellectual Property

   All content, trademarks, and other intellectual property on the App are owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Termination

   We reserve the right to terminate your access to the App at our discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

9. Governing Law and Jurisdiction

   These Terms shall be governed by and construed in accordance with Swiss law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Lausanne, Switzerland.

10. Severability

    If any provision of these Terms is found to be invalid or unenforceable by a Swiss court, the remaining provisions shall continue in full force and effect.
